李朝卿復職案 內政部不同意

南投縣長李朝卿因貪汙案被停職，李朝卿上月申請復職，內政部日前函覆，「不同意李朝卿復職」；建議李朝卿可採訴願方式尋求救濟。李朝卿說，要不要提訴願，他還沒決定。

立委林明溱10天前，曾陪同李朝卿到內政部了解申請復職案的進展，部長由法規會說明。林幾天後打電話給陳威仁，詢問李朝卿復職案。陳威仁告訴林，李朝卿申請復職案的公文，他已批了；但沒有核准復職，因為去年內政部不准復職，並不是他裁定，他沒有理由推翻這項決定。陳威仁建議李朝卿，可循訴願途徑尋求補救。

檢調人員於前年11月底搜索投縣府，李朝卿因涉貪汙案被收押。去年三月，李朝卿獲交保後申請復職，當時內政部長李鴻源說:「依法、依慣例，李朝卿都應該復職」，但後來還是不能復職。

李朝卿不能接受，並反駁地方制度法施行後，他是第一個交保後不能復職的縣市長，法治國家政府要依法行事，復職案不能因人而異。
