「田喬仔」3億贈小三　違反公序良俗全撤銷

桃園市楊姓地主，去年和蔡姓小三分手，大方贈與3億元本票安家，後來小三欠債，將地主贈與的本票拿去抵押，持票人多次向楊姓地主要債，楊姓地主於是向法院聲請撤銷贈與，法院認為楊姓地主贈與小三鉅款，有違社會善良風俗，判定撤銷贈與，楊姓地主暫時確保3億元，全案仍可上訴。
 
法院調查，7旬楊姓地主擁有許多土地，多年前拋棄原配，和蔡姓小三同居，後來感情生變，前年2人協議分手，楊姓地主允諾，以本票支付方式贈與蔡女3億元，但好景不長，本票尚未兌現，2人決裂，楊姓地主憤而寄存證信函給蔡女，撤銷3億元贈與。
 
蔡女和楊姓地主分手後，財物狀況不佳，欠李姓男子1千多萬元，將3張面額各1億元的本票交給李抵債。李拿著本票催討，楊拒付，楊打官司已將本票撤銷贈與為由，訴請本票債權不存在。法院認為蔡姓地主和蔡女婚外情，違反社會善良風俗，因而撤銷贈與。（石明啟／桃園報導）
