顏大和？檢察總長提名 府今公布

府院近日將公布新任檢察總長提名人選，法務部也已研擬修法，將特偵組改設在高等檢察署。法務部長羅瑩雪說，未來的檢察總長還是維持「經立法院同意任命」比較好，因為這樣更具監督和節制特偵組的民意基礎。

總統府今天將公布下一屆檢察總長提名人選，仍以最高檢察署主任檢察官顏大和呼聲最高；法務部政務次長吳陳環則被看好接任高檢署檢察長。顏、吳昨天都表示不知情；法務部相關首長也三緘其口。

行政院長江宜樺，以及法務部長羅瑩雪，前天在立法院答詢立法委員質詢時表示，擬將特偵組從最高檢改設到高檢署。

羅瑩雪昨天指出，該部邀集學者、律師、檢察官和法官代表多次開會討論特偵組存廢，結論認為特偵組有存在的必要，但權力與辦案方式應受節制和監督，所以朝向將特偵組改設到高檢署的方向修正。

她說，將特偵組改設到高檢署，涉及修改法院組織法第六十三條，法務部正研擬草案向司法院提出修法建議，司法院會銜行政院後送立法院修法。

法務部認為，特偵組設在高檢署的優點是，檢察總長可以依指揮個案偵辦的指揮權，監督特偵組辦案和發動偵查的權力；特偵組不起訴的案件，原告還有向最高檢察署再議的救濟管道。
