涉違反證交法 李焜耀二審無罪

創立手機廠牌BENQ的佳世達公司董事長李焜耀等三人，遭控在擔任明基公司董事長期間，利用員工擔任人頭掛名持股卻未申報，違反證交法財報虛偽記載罪，一審獲判無罪。檢方上訴後，二審昨天再判無罪；依速審法規定，檢方上訴權限受限制，李焜耀可望無罪定讞。

李焜耀被控在二○○七年期間涉嫌內線交易，遭檢方起訴；二○一一年七月高院判他無罪時，認為他及前總經理李錫華、前財務副總游克用三人，另外觸犯證交法財報虛偽記載罪責，向桃園地檢署告發。桃檢調查認為，他們於二○○四、二○○五年利用三名員工名義持有明基公司股票一千一百五十張而未向主管機關申報，在公司年報時也未公告，提起公訴。
