只是坐機車上滑行！　騎士酒駕上訴被駁回

基隆市1名48歲王姓男子，去年12月間某日在酒後從家中騎機車至廟口買便當，正要離開時，被警員聞到酒味攔檢，酒測值為O.39毫克，由於王男有酒駕前科，法官裁罰2月，或易科罰金6萬元。

但王男不服上訴，辯稱當天只是吃薑母鴨，且在騎樓上，人坐在機車上方用滑行方式，並未發動機車引擎就被警方抓到。王說，警方可以罰他在騎樓滑行，但沒有酒後騎車，請求撤銷原判決，另為適法判決。但因王男警訊時曾自白酒後騎車買便當，地院二審合議庭認為，根本無所謂「吃薑母鴨，沒有發動車子，當時是滑行，沒有騎摩托車」等情事，駁回聲請，維持原判，不得再上訴。（蔡進男／基隆報導）
