吃到飽剩一堆 被罰投訴

投訴者說上菜慢才來不及吃完，並非「浪費食物」。

不少吃到飽餐廳會限用餐時間，為免食材浪費，還設有吃不完的處罰條款；新北市林姓男子因剩餘食物太多，被店家索取一千二百七十八元罰款，林向消保官申訴，業者退款和解。

林姓男子去年十二月與四名友人，到板橋一家吃到飽餐廳用餐，限時兩小時到了，還有滿桌食物，店家依單價計算一千二百七十八元罰款，食物讓林打包帶走。

林認為不合理，向消保官申訴，表示當天上菜速度慢，且桌上只有一個火爐燒烤，不是吃不下，是時間來不及，且店家「目測」評斷罰錢金額也過高。

業者表示，當天用餐時間已超過廿分鐘以上，且桌上大多是不用煮燙的食物，如壽司、豬排等，顯然是拿太多食物卻吃不下。

新北市消保官陳世欽看了林姓男子提供的「證物」照，訝異剩餘食物之多，但認為對消費者不是不能罰，須符合比例原則。
