正宮告小三「藕斷絲連」 判賠

楊姓女子是張姓男子的小三，經常雙雙出遊，張妻委託徵信社追到高雄市旅社抓姦；事後楊女賠償50萬元，並簽下和解書承諾從此斷絕往來，否則賠償張妻100萬元。因兩人仍藕斷絲連，張妻興訟求償，彰化地方法院昨天判決楊女應賠償張妻20萬元。

彰化地院審理時，楊女辯稱她遵守協議，與張男只是很單純的朋友關係，偶爾見見面、聊聊天，沒有做出越軌的行為。張妻提出徵信社蒐證的資料，指出去年7月到9月間楊女找她丈夫唱歌、散步、吃蚵嗲、到廟拜拜，甚至邀她丈夫到楊女住處喝咖啡。

張妻拿出楊女和張男的電話通聯紀錄，表明去年7、8月楊女打了68通電話給張男，張男在去年7月1日到10月4日更打221次電話給楊女，兩人通話最長時間達1121秒，顯然楊女違背協議，仍繼續與她丈夫往來，應依協議賠償100萬元。合議庭法官認為張妻求償有理，但密集互通電話、出遊，都無法證明楊女與張男通姦，雙方約定違約金過高，裁定賠20萬元。本案仍可上訴。
