棄標被扣保證金 法院靜坐遭函送

梁姓男子去年10月以410萬元標下法拍屋，事後因屋況不好而棄標；此屋重新以386萬元拍定，彰化地方法院從他的保證金扣下24萬元差額。他堅持應全額退還，9個月來常到民事執行處靜坐抗議，前天傍晚法院勸他離開無效，以現行犯提告。

不料，警方問他的姓名、出生年月日、戶籍和住處他都拒答。但警方詢問他，法院控告他天天到民事執行處靜坐、站立或大聲咆哮，有何意見？他回說，他只靜坐或站立，不曾咆哮。警方訊後，依刑法「非法滯留」罪嫌函送彰化地檢署偵辦。昨天梁姓男子未再出現。

秀水鄉55歲梁姓男子去年10月以410萬元標下一間透天厝，並繳了145萬元保證金，但他到現場看屋後，覺得不是他想要的房子，向法院表明棄標。

法院告訴他，棄標的話恐怕無法全額拿回保證金。梁男卻堅持應全額退還保證金。10月24日他改變心意，又帶著尾款265萬元給法院，表明他決定要這間法拍屋；法院發言人李進清庭長說，因已超過公告的繳款日期，法院無法交屋。
