教召請假顧傷嬤 遭法辦不起訴

黃姓男子接獲教召令後，因祖母跌倒，他獨自照顧祖母和幼兒，向軍方請假竟不准，被依妨害兵役罪嫌移送法辦，檢察官查明他家境清苦，祖母確實重病跌倒，並非無故不參加，對他不起訴。

桃園後指部表示，部隊當時曾請黃到指定營區報到再請假，不是不准請假，只是無法確認理由真偽，否則大家都以各種理由請假，教召將無法執行，軍方也是依規定行事、尊重檢察官決定。

檢方調查，黃姓男子（29歲）去年10月11日接到教召令，要他11月18日到新北市部隊報到，報到當天因祖母跌倒，妻子上班，黃忙著照顧祖母又要顧幼兒，曾向營區電話請假，部隊要他「自己來營區請假」，因走不開而沒報到參加教召，被軍方移法辦。

檢察官查出黃的祖母確實當天跌倒，有送醫紀錄，且黃家境清苦，他失業，靠妻掙錢養家，照顧祖母和幼女的工作落在他肩上，他走不開，又沒親人能抽空到營區幫忙請假，並非無故不報到，對黃不起訴。
