丈夫外遇生子　妻告通姦敗訴

林姓女子指控，丁姓丈夫在1990年與陳姓女子外遇，陳女還替他生下一個女兒，他在2011年發現後，委請徵信社蒐證，錄得陳女在登山過後，以擦過自已汗水的毛巾，擦丁男的身體，林女卻遲至2014年才提告，因已逾2年求償時效，遭台北地院判敗訴。

判決指出，林女在得知丈夫外遇生女後，依法應在2年內求償，他卻是在3年後提告，已逾期，且陳姓女子辯稱，1990年與丁男生女後，並未再有婚外情，被拍到擦汗畫面，是一起登山出遊時，純粹好朋友間的幫忙，並不是通姦，法官認為，林女提民事求償時已逾期，刑事通姦案，被告也已獲不起訴，判林女敗訴；仍可上訴。（劉志原／台北報導）
