纏訟10年獲減刑　馮滬祥性侵菲傭判3年4月

前立委馮滬祥被控10年前性侵菲傭案，高等法院更六審今上午仍判有罪，但依《速審法》減刑輕判3年4月，仍可上訴。

66歲的馮滬祥被控於2004年1月23日下午，趁家中無人之際，闖入菲傭Rose房內性侵得逞，馮妻事後拿80萬元給Rose還幫她買機票回菲律賓，後來法院開庭時，Rose隔海視訊改稱未遭性侵，馮因此曾兩度獲判無罪。

但前年底高院更五審認為，馮妻急著把Rose送出國有違常情，且菲傭報案時或哭或氣，就像一般性侵被害人的情緒反應，若菲傭如馮抗辯所稱，是拿馮的精液塗抹自己下體，精子應已死亡，無法游到子宮頸被採集到，認定Rose翻供不足採信，仍判馮4年徒刑。

高院更六審今上午同樣認定馮男有罪，但因本案已纏訟10年，符合《速審法》第7條審理逾8年未能判決確定，有侵害被告受迅速審判權利、予以適當救濟必要時，應減刑的規定，依強制性交罪將馮男改判3年4月，仍可上訴。（黃哲民／台北報導）
