有關公投法中公投門檻的規定，行政院發言人孫立群今天出示立法院公報指出，民國92年公投法修法時，共有三個版本，包括國親共同提出版本、民進黨版以及內政部版（當時的行政院長為游錫堃），不論是那一個版本，均採取雙二分之一門檻規定，顯示當時的執政黨民進黨及民進黨立法院黨團，是肯定並支持現今他們所指責的「鳥籠公投」或「不能公投的公投法」。

孫立群表示，雙二分之一的公投門檻規定是當年朝野共識，民進黨沒有立場否定自己當年力推的公投制度。

對於有媒體報導指江宜樺鬆口公投門檻可下修四成，孫立群表示，絕非事實，行政院立場仍主張依公民投票法規定辦理。
