放完產假竟遭資遣　女經理獲賠60萬

台北市一名廖姓女子2011年在可取國際擔任業務部資深經理，月薪7萬多元，但懷孕7個多月時因業務問題，總經理曾揚言「要開除她」，她向勞工局申訴，雙方達成和解並簽下協議書，公司允諾不會將她解僱，不料去年放完產假回到公司，公司竟發e-mail將她資遣，她怒告公司違約，並求償18個月薪資共139萬元。士林地院今判可取國際敗訴，須賠廖女60萬元。
 
廖女指控，當時她挺著大肚子，不但擔任業務部經理，還兼任維修經理、專案經理職務，卻只因出貨問題遭總經理恐嚇開除，「害我差點早產」，廖女原本控告總經理恐嚇，但在勞工局和解簽訂協議書後撤告，公司則答應到今年12月底為止，不得將她解僱。
 
不料，去年4月廖女生產後回公司，竟收到資遣的e-mail，公司宣稱協議指「不得解僱，但不包括資遣」，還反控廖女違反保密協定。法官認為廖女並未違反保密協定，且雙方協議書仍有效，但廖女求償金額過高，今判可取國際須賠60萬元。（吳珮如／台北報導）
