新婚妻外遇 對象是伴郎

吳姓、王姓男子情同手足，吳還擔任王的伴郎，孰料婚後，伴郎與新娘婚外情，丈夫控告兩人妨害家庭並求償。王妻辯稱是婆婆太愛錢，夫妻感情生變，一審判決兩人共應賠償38萬元。

王與吳是多年朋友，兩人交情是「死忠兼換帖」，兩年前王結婚，吳擔任伴郎。但結婚不到1年，意外發現妻子的手機有好友與妻子的曖昧簡訊，且已持續兩個月，立即要求吳與妻子不能再來往，兩人也表示後悔，同意不往來。

事實上兩人繼續交往，去年間王跟蹤到台南市北區某汽車旅館，抓到姦情，除控告他們妨害家庭，並求償精神損失，也離了婚。王表示，他平日對妻子呵護有加，沒想到是以真心換取妻子的絕情。他說，「朋友妻不可戲」但最要好的朋友卻背叛，要求妻子與吳各賠償100萬元。刑事部分吳與王妻各被判刑4月及3月。

妻子卻指婆婆超愛錢，在家做月子時向她收月子費；她請育嬰家在家照顧孩子，婆婆每月也要收保母費。加上丈夫之前與女性友人也有外遇，夫妻感情才會發生問題。

但因妻子無法舉證王有外遇，台南地院法官判決兩人各應賠償精神撫慰金20萬元給王。但扣掉吳毀損王的汽車及打傷王所需付的醫療費用，實際上賠償38萬元，全案仍可上訴。
