不滿考績 警員興訟敗訴

任職新竹警方張姓警務員，自認辦業務表現不差，曾獲上級嘉獎肯定，但某課長卻在他考績表寫「業務不落實」等評語，且考績打乙等，認為對方惡意考核不實，藉此羞辱他，侵害名譽權，提出民事損害賠償，請求賠償10萬並登報道歉。一審法官認為，該課長有考核原告工作表現權限，不能以曾記嘉獎，就認定考核憑空捏造，認定沒有侵害名譽權，判決這名警務員敗訴。張員不服，提上訴，新竹地院合議庭法官認為一審民事小額判決未違背法令，駁回上訴，且不得抗告。
