收拉法葉艦回扣104億　郭力恆判刑不必關

25年前拉法葉艦採購弊案，最高法院認定海軍前上校郭力恆和軍火商汪傳浦是共犯，共同收受法商湯普笙公司回扣3.4億美金（現值約台幣104億元），今依公務員收取回扣罪判郭力恆15年徒刑、罰金2億元，褫奪公權10年，還須與汪連帶追繳104億元贓款，他哥哥郭問天也因幫助洗錢遭判刑2年、罰金1千萬元。

瑞士已將郭力恆兄弟遭凍結的3500萬美元（約台幣11億元）犯罪所得，匯回我國專戶暫時保管，至於汪傳浦在瑞士銀行的5億美元存款及英屬澤西島約450萬英鎊資產，也都被凍結，最高檢正透過司法互助，追討拉法葉案相關犯罪所得。

不過，郭力恆因另洩露獵雷艦採購案機密，被判無期徒刑定讞，去年底已刑滿出獄，故除非他再犯其他案件被判死刑，否則依法不必再入監服刑。（劉志原／台北報導）
