台中知名餐廳「新月梧桐」負責人羅友竹和丈夫翁博文，2005年間協議離婚，去年羅女要求前夫履行離婚協議內容，每月給付30萬元贍養費，提告先請求60個月金額共1477萬餘元，台中地院審理後指2人離婚時，李姓代書以自己和母親為證人，但李母未親自見聞，也非親自蓋章、簽名，所以認定羅、翁離婚無效，駁回羅女要求給付贍養費的請求。
 
羅、翁離婚後已各自嫁娶，雙方原本各自努力相安無事，卻因羅女經營的「新月梧桐」餐廳租約到期後，翁男租下該址，另開設「品虹橋」餐廳，羅女指前夫，挖角廚師、抄襲菜單、削價競爭，她氣不過，才提告要求丈夫給付贍養費，羅女說：「我要告訴他，你還欠我很多。」
 
不料，訴訟進了法院，法官發現該名李姓代書辦理的離婚協議，已經出現3件都因李母不是親見親聞的離婚證人，讓離婚協議變成無效，法官為此傳喚李姓代書的母親，她坦承羅、翁離婚不是自己蓋章、簽名，法官因此裁定此離婚協議無效，羅女無法依協議要求給付贍養費，而翁男則已另提確認婚姻官司存在訴訟。(許淑惠／台中報導)
