役男網戀國中男　愛愛1次判緩刑

高雄1名高姓男大生前年7月服役期間，上網認識住在新北市的13歲國中男生，交往成為情侶，同年8月，高男將小男生帶回高雄住處，2人情不自禁發生關係。小男生回到學校後，偶然向學校輔導老師提及曾與他人發生性行為，校方趕緊通報警方循線找到高男。高雄地院審理認為高男犯行情堪憫恕，引《刑法》第59條為他減刑，判處有期徒刑2年，緩刑3年，並應支付公庫5萬元。
 
判決指出，高男當時年僅22歲，思慮欠周，且因與小男生情投意合，於交往期間一時無法控制性慾而犯錯，但他並未使用強暴脅迫，或任何違反被害人意願之手段，犯罪情節與惡性均非重大；且他目前仍就讀大學，到案後坦承犯行，頗見悔意，被害人在偵查期間也表示不想對高男提告，在此情況下，若依法定刑判處有期徒刑3年以上，仍嫌過重，不符罪刑相當性原則及比例原則，因此依《刑法》第59條規定予以減輕。（王吟芳／高雄報導）
