(一)其實重點在於你們有沒有竊盜的犯意,當然這要看法官的證據認定,純就理論上來說,如果妳們有犯意,至少構成竊盜未遂至於到底要不要認定成無主物那是另一問題,因為即使認定成無主物,如果你們是依竊盜罪的犯意去實行時,將涉不能未遂的問題,問題這邊不符不能未遂情形,故至少構成竊盜未遂罪,若該東西還沒形成無主物則構成竊盜既遂罪
(二)如果東西有動過,而且只剩一點點,跟完全沒動過
或者婦人是否已離去遠處,還是只是去附近上廁所
這些客觀情狀,都會影響法官證據認定等等
